Business Rescue was introduced in Chapter 6 of the new Companies Act, No 71 of 2008 and came into effect on 1 st May 2011.

What is “Business Rescue”

It is defined as proceedings to rescue and rehabilitate a financially distressed Company.

A financially distressed Company is defined in the Act that it appears to be reasonably unlikely that the company will be able to pay all of its debts as they become due and payable with the immediately ensuing six months, or ir appears to be reasonably likely that the company will become insolvent within the immediate ensuing six months.
